Terms and Conditions

1. Introduction
Welcome to DishWise (“DishWise,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our mobile applications, websites (including dishwise.co), and any related products or services (collectively, the “Services”). By tapping “I Agree” on our onboarding screen and using our Services, you expressly consent to be bound by these Terms and our Privacy Policy (available at https://dishwise.co/terms-and-conditions/privacy-policy). If you do not agree with these Terms, please discontinue use of our Services.
2. Acceptance of Terms
By creating an account, downloading our mobile application, or otherwise using our Services, you represent that you have read, understood, and agree to be bound by these Terms. If you are acting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
3. Eligibility and Age Requirements
Minimum Age: You must be at least 13 years old (or the applicable age of majority in your jurisdiction) to use our Services.
Parental Consent: If you are under 18, you must have your parent or guardian’s permission to use our Services, and your parent or guardian must review and accept these Terms on your behalf.
Note: We do not currently implement an age verification process; by using our Services, you confirm that you meet the applicable age requirement. DishWise reserves the right to suspend or terminate access if we later determine that these requirements have not been met.
4. Account Registration and Security
Accuracy of Information: You agree to provide accurate, current, and complete information when registering for an account.
Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Notification: You must immediately notify us of any unauthorized use or security breach related to your account.
5. License and Use of Services
Limited License: Subject to your compliance with these Terms, DishWise grants you a non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.
Prohibited Uses: You agree not to use the Services for any unlawful, fraudulent, or unauthorized purpose; to modify, adapt, or create derivative works; to circumvent security measures; or to use automated methods to access our Services.
6. User Content
Submission: You may upload, post, or submit reviews, feedback, or other content (“User Content”) through our Services.
Ownership and License: You retain ownership of your User Content but grant DishWise a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, distribute, display, and modify your User Content in connection with the Services.
Compliance: You warrant that you have the rights to submit the User Content and that it does not infringe on any third-party rights or violate any laws.
Removal: We reserve the right to remove any User Content at our discretion without notice.
7. Nutritional & Diet Information Disclaimer
Informational Purposes Only: All nutritional, dietary, and allergen-related information provided by DishWise is for general informational purposes only.
No Professional Advice: DishWise is not a licensed healthcare or medical provider. The Services do not provide personalized health, medical, or dietary advice.
User Responsibility: You are solely responsible for verifying allergen or ingredient information with restaurant staff or reliable sources.
8. Personal Data & Privacy
Data Collection: We collect, use, store, and process personal data such as account details, dietary preferences, location data (with your consent), usage data, and device information.
Privacy Policy: Please refer to our Privacy Policy at https://dishwise.co/terms-and-conditions/privacy-policy for detailed information on our data practices.
International Transfers: As DishWise is currently available only in the USA, your data is processed within U.S. borders. In the event of any international data transfer, we take steps to ensure compliance with applicable laws.
9. In-App Purchases and Subscriptions (If Applicable)
Billing: Certain features of the Services may require payment or subscription. By providing payment information, you authorize DishWise or our third-party processors to charge applicable fees, including recurring subscription fees.
Renewals/Cancellations: Subscription details—including auto-renewals and cancellation policies—are provided at the point of purchase. If you subscribed via Apple’s App Store, additional terms apply.
Refunds: Except as required by law or as stated at the time of purchase, all fees are non-refundable.
10. Third-Party Links and Content
The Services may include links to third-party websites or resources. DishWise is not responsible for the privacy practices or content of these third parties. We encourage you to review their policies before engaging with them.
11. Termination
By You: You may discontinue using our Services at any time by deleting your account or uninstalling the app.
By Us: DishWise reserves the right to suspend or terminate your access at our sole discretion for any violation of these Terms or applicable laws.
Effect of Termination: Upon termination, your right to use the Services ceases immediately. Certain provisions (e.g., disclaimers, limitation of liability, and indemnification) will continue to apply.
12. Disclaimer of Warranties
AS IS Basis: The Services are provided “as is” and “as available” without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Accuracy: DishWise does not guarantee that the Services will be uninterrupted, error-free, or secure, or that the content provided is accurate.
User Risk: You rely on the Services at your own risk.
13. Limitation of Liability
Indirect Damages: To the maximum extent permitted by law, DishWise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Services.
Cap on Liability: In no event shall DishWise’s total liability for any claims exceed the amount paid by you in the six months preceding the event giving rise to the claim (or US $50 if no payments were made).
14. Indemnification
You agree to indemnify and hold harmless DishWise and its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from (i) your use of the Services, (ii) your User Content, (iii) your violation of these Terms, or (iv) any violation of third-party rights.
15. Governing Law & Dispute Resolution
Governing Law: These Terms shall be governed by the laws of the State of California, USA, without regard to conflict of law principles.
Arbitration: Any dispute arising out of or related to these Terms or the Services that cannot be resolved through informal negotiations will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You agree to resolve disputes on an individual basis and waive any right to participate in a class action.
Small Claims: Notwithstanding the above, either party may bring an individual action in small claims court if applicable.
16. Changes to These Terms
We may update these Terms from time to time. For any significant changes, we will notify you via the Services and update the “Last Updated” date. Your continued use of DishWise after such changes constitutes your acceptance of the updated Terms.
